100 A N N E X I SUPERVISION OF ERECTION, START-UP AND OPERATION OF SELLER’S PLANTS Upon Buyer's written request to be made normally sixty days prior to anticipated need, the Seller will send qualified engineers on the following conditions: 1) Erection Supervisor(s) will be sent after the Buyer reports that the work assigned to him have been completed and as soon as the materials and equipment have reached the site. 2) The Buyer will provide erection Supervisor(s) with all the facilities to carry out their work continuously; it is understood that if for any reason, the work by the Supervisor(s) is interrupted, the corresponding expenses will be at Buyer's charge. 3) Seller's personnel should not be asked to do jobs that do not come within their duties or are not clearly stated in orders or expressly authorised each time by the Seller. The Buyer will supply, at his own expenses and under his responsibility, the necessary auxiliary workers and technical means. He will also do all that is necessary to guarantee that the erection work can start immediately after the arrival of the supervisor(s) and is carried on without interruption until completion. 4) Assistance in the start-up and testing of the plant will be given by Seller’s startup engineer(s) who will be sent when erection has been completed and all the parts of the plant have been tested. 5) Tests runs will be considered as completed when it is possible to operate the plant even if for some reason there are some accessory parts that are missing or not included during operation. 6) After 72 aurs of performance test runs have been completed, the Buyer will issue a letter of acceptance to Seller’s start-up engineer, relieving the Seller of all responsibilities regarding plant operation, except for the mechanical guarantees given on receiving the order. In case a letter of acceptance is not issued and the plant is nevertheless operated, the Seller will not accept any claim concerning the plant; moreover, in this case, the Seller’s responsibilities on mechanical guarantees will be reduced accordingly. 7) The start-up Engineer(s) can also be sent, upon request, to assist the Buyer during plant operation in such tasks as: - maintenance of the plant - control of plant operation and performance 5
