A N N E X I I MACHINERY GUARANTEES The Seller guarantees that all the machinery and equipment supplied for the plant will be brand new, of first class quality and workmanship and that, under normal operating conditions, they will show no defects due to faulty design, materials and workmanship, for a period of 12 months from the date of plant start-up but not more than 18 months from the date of the last shipment. The Seller undertakes to repair and/or replace ex works, any machinery and equipment or parts thereof which may be found defective during the guarantee period. However, the Seller will not be responsible for any damage or defects to the machinery and equipment arising from faulty operation, lack of maintenance, any alterations carried out by the Buyer's personnel without prior consent of the Seller in writing, or from normal wear and tear. 7
